These Terms and Conditions govern your use of the AccessiYes website (accessyes.com) and the AccessiYes WordPress plugin. By accessing this website or installing the plugin, you agree to be bound by these Terms. If you do not agree, please do not use this website or the plugin.

2. Use of this website

The AccessiYes website is provided for informational purposes. We do not offer user accounts, subscriptions, or paid services on this website.

You must not use this website in any way that is unlawful, fraudulent, or harmful, or in connection with any unlawful, fraudulent, or harmful purpose or activity. Specifically, you must not:

  • attempt to gain unauthorised access to the website, its servers, or any systems connected to it;
  • use automated tools to scrape, crawl, or systematically extract content from the website in a manner that places an unreasonable load on our infrastructure;
  • transmit any unsolicited or unauthorised advertising or promotional material;
  • knowingly transmit data that contains viruses, malware, or other harmful software.

3. The AccessiYes plugin

Open-source licence

The AccessiYes plugin is free, open-source software released under the GNU General Public Licence version 2 (GPLv2). You are free to use, copy, modify, and distribute the plugin code in accordance with the terms of the GPLv2. A copy of the licence is available at gnu.org/licenses/old-licenses/gpl-2.0.html.

No warranty

The plugin is provided "as is", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. CookieYes Limited does not warrant that the plugin will be error-free or uninterrupted.

No guarantee of compliance

The AccessiYes plugin is an accessibility widget. It helps your visitors adapt your site to their needs and directly supports a number of Web Content Accessibility Guidelines (WCAG) 2.1 AA success criteria. However, it does not make your website fully WCAG compliant, ADA compliant, or compliant with any other legal or technical accessibility standard on its own. Full compliance also depends on your site's underlying design, content, and code, and may require additional work beyond installing the plugin.

CookieYes Limited accepts no liability for any legal claims, penalties, or losses arising from your reliance on the plugin as your sole means of achieving accessibility compliance.

4. Intellectual property

The content of this website, including text, graphics, logos, the AccessiYes name, and the AccessiYes branding, is owned by or licensed to CookieYes Limited and is protected by copyright, trade mark, and other intellectual property laws. You may not reproduce, distribute, or use this content without our prior written permission, except as permitted by law.

The AccessiYes plugin code is open-source software licensed under GPLv2. Your rights to use and adapt the plugin code are governed by that licence, not by these Terms.

5. Limitation of liability

To the fullest extent permitted by applicable law, CookieYes Limited shall not be liable for any indirect, incidental, special, or consequential loss or damage arising out of or in connection with your use of this website or the AccessiYes plugin, including but not limited to loss of profits, loss of data, or business interruption.

Our total aggregate liability to you for any claim arising from your use of this website shall not exceed one hundred pounds sterling (GBP 100).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

6. Links to third-party websites

This website contains links to third-party websites, including WordPress.org. These links are provided for your convenience only. We have no control over the content, privacy practices, or terms of any third-party website, and we accept no responsibility for them. A link does not constitute an endorsement of the linked website or its operator.

7. Changes to these Terms

We may update these Terms and Conditions from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. When we do, we will update the "Last reviewed" date at the top of this page. Continued use of this website after any update constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

8. Governing law and jurisdiction
